(Geneva, 22 June 2017) – Today marks six months of detention for Jatupat “Pai” Boonpattararaksa, a prominent student activist who has been charged with lèse majesté offences under article 112 of the Thai Criminal Code and violation of the Computer Crime Act since 22 December 2016. Pai was arrested on 3 December 2016 after sharing on Facebook a biographical article from BBC Thai on King Rama X. He was released on bail on 4 December 2016 but his bail was revoked on 22 December 2016. Since then several new bail applications have been submitted and all have been rejected.

The Asian Forum for Human Rights and Development (FORUM-ASIA) condemns the arbitrary detention of Pai and echoes the call from the United Nations Special Rapporteur on the right to freedom of expression and opinion (UNSR on freedom of expression), David Kaye, to revise the Criminal Code and repeal the law that criminalises free speech. FORUM-ASIA expresses further concern on recent threats and intimidations against other political activists and human rights defenders by the authorities.

Lèse majesté in Thailand is a known tool to effectively silence critics and political activists by imposing heavy and disproportionate sentences. The United Nations High Commissioner on Human Rights, Zeid Ra’ad Al Hussein, also expressed his concern over the increasing number of lèse majesté cases after 2014 coup and called on the Thai Government to amend the law to be in compliance with international human rights standard and review all cases prosecuted under lèse majesté.

FORUM-ASIA reiterates its call on the Thai Government to comply with its pledges made during the second cycle of the Universal Periodic Review (UPR) in 2016, when the Thai Government accepted many general recommendations to safeguard the rights to the freedoms of expression and assembly, to protect human rights defenders, and to redress reported cases of harassment and attacks against them. Granting Pai bail would be an important indication of the Thai Government’s commitment to the implementation of the accepted recommendations. Failure to do so, would be indicative of the authorities’ lack of adherence to internationally accepted human rights initiatives.

(เจนีวา 22 มิถุนายน 2560) วันนี้เป็นวันครบรอบหกเดือนที่จตุภัทร์ บุญภัทรรักษา หรือ ไผ่ ซึ่งเป็นนักศึกษาและนักเคลื่อนไหวได้ถูกควบคุมตัวตั้งแต่วันที่ 22 ธันวาคม 2559 ภายใต้การฟ้องร้องในข้อกล่าวหาความผิดต่อองค์พระมหากษัตริย์ (Lèse majesté) ตามประมวลกฎหมายอาญา มาตรา 112 และ ความผิดตามพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ ไผ่ถูกจับกุมเมื่อวันที่ 3 ธันวาคม 2559 จากการเผยแพร่ข่าวพระราชประวัติ รัชกาลที่ 10 ของสำนักข่าวบีบีซีไทยลงบนเฟสบุ๊คของตน ไผ่ได้รับการประกันตัวในวันที่ 4 ธันวาคม 2559 แต่ต่อมาทางเจ้าหน้าที่ได้เพิกถอนการประกันตัวในวันที่ 22 ธันวาคม 2559 และนับแต่นั้นมา การยื่นขอประกันตัวก็ได้รับการปฏิเสธมาโดยตลอด

สมาคมนานาชาติเพื่อสิทธิมนุษยชนและการพัฒนาแห่งเอเชีย หรือ ฟอรั่มเอเชีย (FORUM-ASIA) ขอประณามการควบคุมตัวโดยพลการ (arbitrary detention) ต่อไผ่ และขอสนับสนุนข้อเรียกร้องของ ผู้รายงานพิเศษแห่งสหประชาชาติ ด้านสิทธิเสรีภาพในการแสดงความคิดเห็นและการแสดงออก เดวิด เคย์ (David Kaye) ต่อรัฐบาลไทยให้ทบทวนประมวลกฎหมายอาญาและยกเลิกกฎหมายที่กำหนดโทษที่ส่งผลกระทบต่อเสรีภาพในการพูด นอกจากนี้ ฟอรั่มเอเชีย ขอแสดงความกังวลต่อการข่มขู่ คุกคามโดยเจ้าหน้าที่รัฐ ต่อนักกิจกรรมทางการเมืองและนักปกป้องสิทธิมนุษยชนคนอื่นๆ ด้วย

ความผิดต่อองค์พระมหากษัตริย์ (Lèse majesté) ในประเทศไทย เป็นเครื่องมือของรัฐที่ถูกนำมาใช้เพื่อปิดปากนักวิจารณ์และนักเคลื่อนไหวสิทธิทางการเมืองผ่านคำตัดสินที่รุนแรงและไม่ได้สัดส่วน ทั้งนี้ ข้าหลวงใหญ่สิทธิมนุษยชนแห่งสหประชาชาติ นายชะอีด รออัด อัลฮุสเซน (Zeid Ra’ad Al Hussein) ได้แสดงความคิดเห็นต่อจำนวนของคดีความผิดต่อองค์พระมหากษัตริย์ที่เพิ่มขึ้นอย่างก้าวกระโดดนับตั้งแต่รัฐประหารปี 2557 และได้เรียกร้องไปยังรัฐบาลไทยในการแก้ไขกฎหมายให้สอดคล้องกับหลักการสากลว่าด้วยสิทธิมนุษยชนและให้ทบทวนคดีความทั้งหมดที่ถูกดำเนินคดีภายใต้ฐานความผิดดังกล่าว

ฟอรั่มเอเชียขอกล่าวย้ำเตือนถึงข้อเรียกร้องของเราต่อรัฐบาลไทยในการปฏิบัติตามข้อผูกมัดที่ได้ให้เอาไว้ในช่วง กระบวนการทบทวนสถานการณ์สิทธิมนุษยชนหรือ Universal Periodic Review (UPR) ครั้งที่ 2 เมื่อปี 2559 ซึ่งรัฐบาลไทยได้ตอบรับข้อเสนอแนะทั่วไปที่จะปกป้องสิทธิในเสรีภาพการแสดงความคิดเห็น, เสรีภาพ ในการชุมนุม, คุ้มครองนักปกป้องสิทธิมนุษยชน และ เยียวยาการคุกคามและการทำร้ายนักปกป้องสิทธิฯ ดังนี้ การให้ประกันตัวจตุภัทร์ บุญภัทรรักษา หรือ ไผ่ จะถือเป็นตัวชี้วัดสำคัญต่อรัฐบาลไทยในการทำตามข้อผูกมัดที่จะปฏิบัติตามข้อเสนอแนะที่ได้ทำการตอบรับไว้ ในขณะเดียกวัน การไม่สามารถปฏิบัติตามสิ่งที่กล่าวไปข้างต้น ย่อมเป็นตัวชี้วัดถึงความขาดการยึดมั่นของรัฐบาลไทยต่อการปฏิบัติตามหลักสิทธิมนุษยชนสากล
